GENERAL TERMS AND CONDITIONS OF THE YOGASTUDIO YOGALIFE
1 Scope of application
These terms and conditions apply to all offers and services of the yoga studio YOGALIFE, Loftus Park, Building B - LOFTUS MEDICAL Centre. By purchasing a valid card, concluding a membership contract or registering for a workshop either online or on site at the studio, a contract is concluded with YOGALIFE under the following conditions of participation:
If attendance at an event at the studio is subject to special admission requirements, these will be listed separately in the course programme and on the website www.barbarastark.com and must therefore be fulfilled by the participants.
2. rights of participation
2.1
By purchasing a valid card/pass/membership contract/registering for a workshop, Customers are entitled to use the premises of the YOGALIFE Studio during the course times offered. Customers are also authorised to use the premises 20 minutes before and after the end of the class/workshop for the purpose of changing clothes. Customers undertake to provide proof of their identity at the request of YOGALIFE Studio staff, otherwise they may be prohibited from using the premises.
2.2
In principle, all services of the YOGALIFE Studio are available to customers upon payment. However, there is no legal entitlement to the utilisation of services. Customers are not entitled to services in the event that personal conditions of participation announced by YOGALIFE are not fulfilled by the Customers or in the event that open course or workshop hours with a limited number of participants are fully booked.
2.3
Participation in yoga classes/workshops is only possible if the Client arrives at the Studio at the specified start time. For organisational reasons and out of consideration for the other participants, no admission can be granted after the start of the respective class. Registered clients must check in at the studio reception up to ten minutes before the start of the class, otherwise the reserved space will be released for other clients. The late arrival of the customer will be treated as a late cancellation (point 3.3.).
2.4
The customer must always behave in the studio premises in such a way that the course of the lessons/workshops is not disrupted. The equipment of the studio must be treated with care and there must be no interference with other participants. Absolute silence must be maintained during a class and any disturbance, especially from technical equipment, must be avoided. The customer must adhere to the instructions of YogaKula employees, which specify these rules in the interest of all participants.
In the event of gross violations of these general terms and conditions by the customer and corresponding instructions from employees, e.g. in the event of assault, threats, insults, sexual harassment, theft, lack of hygiene, etc., access to the YOGALIFE studio may be denied for the entire duration of the contract or under expiry of open passes (e.g. blocks of 10) at the first offence, without this leading to a refund obligation by YOGALIFE. In order to avoid conflicts among the participants and to maintain peace and quiet and the orderly, undisturbed course of events, YOGALIFE is also granted the right to refuse to provide further services without giving reasons. In this case, unused passes (e.g. blocks of 10) must be refunded (aliquot).
2.5
Anmeldungen für Yogaklassen/Workshops werden in der Reihenfolge ihres Eintreffens berücksichtigt und sind gültig ab dem Einlangen der Ausbildungs-/Seminar-/Klassen-Kosten auf das angegebene Firmenkonto. Das YOGALIFE Studio nimmt Anmeldungen sowie Umbuchungen und Stornierungen nur über das elektronische Onlinesystem (Studiobookingsonline.com) oder schriftlich (e-Mail oder Post) entgegen. Jede Anmeldung ist verbindlich.
3 Types of contract, prices and conditions
3.1
The customer can choose from the following passes/contracts:
INTRO - Beginner Trial Pass
Entitles the customer to participate in 3 yoga sessions within 2 weeks for R 188. The taster offer is only available ONCE for new customers and is not transferable or refundable.
DROP-IN
Entitles you to participate in a 60-minute class for R 300.-- (participation in 90-minute classes at the same price is a bonus granted by YOGALIFE).
5 CLASSES CARD
Entitles the holder to attend five classes at the YOGALIFE studio at a cost of R 750. A credit note for units not consumed is not possible. The block of 5 classes is valid for a period of 2 months from the first visit and cannot be extended or redeemed in cash.
10 CLASSES CARD
Entitles the holder to ten classes at the YOGALIFE studio at a price of R 1,300. A credit note for unused units is not possible. The block of 10 classes is valid for a period of 3 months from the first visit and cannot be extended or redeemed in cash.
1 MONTH
Entitles you to participate in all classes (including workshops) for a period of one month at the price of R 1,100.--
PRIVATE CLASSES
Entitles the holder to participate in a single lesson and can be purchased individually or as a block of 5. Purchased 5 session packages are valid for 3 months. Special cancellation rules apply to private classes as detailed in point 3.3. of these terms and conditions.
3.2
Prices and payment:
All prices, including discounts, are shown on the YOGALIFE Studio website and are understood to be retail prices.
Payment is made when purchasing the respective pass/via the payment and booking platform Studiobookingonline.com, in any case before the start of the respective class/workshop.
3.3
Cancellations of workshops/ yoga classes/ basic courses
Cancellations of yoga classes can only be made via the online system (Studiobookingonline.com) of the YOGALIFE studio. Cancellation of yoga classes is possible free of charge up to two hours before the start of the class. If cancelled later, the full amount will be charged.
Private classes must be cancelled up to 24 hours before the start of the class, otherwise the full amount will be charged.
Even/workshop bookings can only be cancelled in writing by e-mail, but the workshop fee is non-refundable.
3.4
Changes to the course or event programme, cancellation
Due to the generally long-term planning, programme changes are possible. YOGALIFE Studio reserves the right to make changes to event dates and locations, starting times and course rooms, instructors and any event cancellations. Participants will be informed in good time and in writing (by e-mail). In the event of cancellation of an event due to illness or other unforeseen events, the customer has no right to claim that the event will be held on time. Compensation for expenses incurred and other claims against the YOGALIFE Studio do not exist. The same applies to postponements or changes to the timetable or teachers that become necessary at short notice. If an event has to be cancelled, any fees already paid will be refunded without deduction.
3.5
Workshops
All workshops are held with a minimum of 2 participants. If a workshop is cancelled due to too few registrations, the registration fee will either be refunded or can be used as a credit for a future workshop. If a workshop has to be cancelled by YOGALIFE for other reasons, the money will also be refunded.
4. cancellation for good cause
Cards can only be cancelled BEFORE the expiry date for good cause, in particular in the event of illness (doctor's certificate) or pregnancy. In this case, a written request must be sent by email to barbara.stark@gmx.at. Non-use of the YOGALIFE offer due to other reasons within the customer's sphere of responsibility, which do not entitle the customer to extraordinary cancellation/cancellation, does not entitle the customer to a reduction or refund of his payment.
5. state of health and liability
Participation is at your own risk and peril. YOGLIFE is not liable for the consequences of improperly performed exercises and any resulting damage to health. By purchasing a class/pass/membership, the customer declares that he/she is healthy and mentally stable and able to cope with the relevant physical and mental demands and will only participate in yoga classes or workshops in such a condition. Participation in yoga classes or workshops under the influence of drugs and/or alcohol is not permitted.
The customer assures with his/her participation that he/she does not suffer from any infectious disease and that there are no medical reasons preventing the yoga exercises to be performed. In case of doubt, a doctor must be consulted. Chronic illnesses and other physical or mental conditions that could affect or jeopardise the yoga practice of other participants must be reported to the instructor before the start of each class. In the case of pregnancy, the customer must obtain a doctor's authorisation before participating.
The employees of YOGALIFE are authorised - without this triggering an obligation to examine or liability for the decision - to refuse the customer the practice of yoga classes according to their own assessment of the customer's state of health. In such a case, the customer has no right to a refund or rebooking.
